Disclaimer & Limitation of Liability

Last updated: 29 September 2026

Pages like this are usually written to make a company sound blameless. That is not the intention here. Below is what we accept responsibility for, what sits with the bus operator, and — importantly — the things no disclaimer can take away from you.

1. Our role

PathYatra, operated by PathYatra, currently operated by its founders Abhinav Mandal and Abhishek Mandal, is a technology platform. We provide software for bus operators and a booking channel for passengers. We do not own, operate, drive, maintain or inspect any bus. Each journey is provided by an independent operator with their own permit, vehicle, staff and insurance.

2. What we are responsible for

  • Providing the platform with reasonable skill and care.
  • Handling your personal data as set out in the Privacy Policy.
  • Calculating and paying operator settlements correctly, as set out in the Payments, Commission & Settlement policy.
  • Processing refunds we have approved, and doing so to the original payment method.
  • Investigating complaints through Grievance Redressal and acting on safety reports under the Safety Policy.
  • Being accurate in what we ourselves tell you.

3. What sits with the bus operator

The conduct of the journey is the operator's. That includes the condition and roadworthiness of the vehicle, the competence and behaviour of the driver and conductor, departure and arrival times, the route taken, boarding arrangements, luggage handling, and compliance with transport law.

Information shown on a listing — fares, timings, seat layout, amenities, boarding points — is supplied by the operator. We display it in good faith. Where it turns out to be wrong, tell us: we will correct it, deal with the operator, and apply the Refund & Cancellation Policy in your favour where the operator misrepresented the service.

4. Things genuinely outside anyone's control

Neither we nor the operator can be responsible for delays or cancellations caused by traffic, weather, floods, road closures, accidents on the route, strikes, protests, police or government action, power or network failure, or similar events beyond reasonable control. We will tell you what we know as soon as we know it.

5. Availability of the service

We work to keep PathYatra available and accurate, but we do not guarantee uninterrupted or error-free operation. Features may be added, changed or withdrawn. Where we plan maintenance that will interrupt bookings, we will give notice where we reasonably can.

6. Third parties

Payments, hosting, maps, messaging and analytics are provided by third parties operating under their own terms. We select them with care but do not control them. Their failure is not something we can guarantee against — though where your money is involved, we will pursue it with them on your behalf rather than leaving you to it.

7. Limitation of liability

Subject entirely to section 8, and to the extent permitted by law, we are not liable for indirect or consequential loss — such as loss of profit, loss of business opportunity, or a missed connection, event or appointment — arising from use of the platform.

8. What cannot be limited — and we are not trying to

Nothing on this page, or anywhere else on this site, excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • your rights under the Consumer Protection Act and the rules made under it, including your right to approach a consumer forum;
  • our obligations and your rights under India's data protection law;
  • anything else that the law does not allow us to exclude.

If any part of this page conflicts with that, this section wins. A disclaimer does not override a statute, and a policy that pretends otherwise simply gets ignored by a court while damaging trust in the meantime.

9. External links

Where we link to another website, we do not control its content and are not responsible for it. The link is not an endorsement.
